TERMS AND CONDITIONS
FORMATION OF THE CONTACT
All goods sold by Belinda Nott are sold subject to these conditions which the buyer shall have indicated acceptance of by placing an order for the goods, or acceptance of the goods.
RETURNS
You may return any unused goods you buy from me, within 14 days of the sale. To enable me to authorise a return, you must contact me via telephone on 01787 269467, or email me via my contact page (info@belindanott.com) stating your name, telephone number, delivery postcode, item purchased and reason for return. If you do not notify me accordingly, you shall not be entitled to reject the goods and I shall have no liability for faulty or damaged items, and you shall be bound to pay the price of the goods.
If the goods are faulty or damaged, once the goods have been returned and inspected, I will refund the cost of the goods and postage to you, or a replacement can be sent to you free charge and the cost of you returning the faulty goods will be refunded. Please note original artworks cannot be replaced so would be refunded. If a replacement is out of stock so causing a delay, I shall contact you with approximate replacement times, then you can decide to wait or have a refund.
If the goods are returned for any other reason, postage costs are the responsibility of the buyer. Once the goods have been returned in the allotted time, unused and in their original packing, they will be inspected, then the cost of the goods will be refunded.
All returned paintings must be sent requiring a signature from the seller to confirm that they have been received, as title for ownership remains with the buyer until I have signed for the return. If you are returning cards or prints please obtain a Proof of Posting Certificate from your Post Office as I cannot be held responsible for items lost in the post.
If the returned goods are found to be used or the packaging is not suitable for re-sale, any refund or replacement will be refused and the goods will only be returned to the buyer once return and re-send costs are paid by the buyer.
The seller’s liability to the buyer shall not exceed the cost of such goods.
BASIS OF THE SALE
Any advice or recommendation given by the seller to the buyer is followed or acted upon entirely at the buyers own risk.
Any typographical, clerical or other error or omission in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by the seller shall be subject to correction without any liability on the part of the seller.
PRICE
The price of the goods shall be the sellers quoted price at the date of acceptance of the order.
LIABILITY
The seller shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow the seller’s instructions [whether oral or in writing], misuse or alteration or repair of the goods.
The seller shall not be liable to the buyer or be deemed to be in breach of the contract by reason of any delay in performing, or any failure to perform, any of the seller’s obligations in relation to the goods, if the delay or failure was due to any force majeure.
GENERAL
The contract shall be governed by English law.
